The lawsuit, filed Friday in U. S. District Court in Manhattan, alleges that the drug maker has used the word "erection" instead of its medical name, "Viagra."
The suit, filed Friday in federal court in Brooklyn, alleges that the drug maker has "deceptively" marketed the drug as having little to no effect on men's sexual function. The suit also alleges that the drug maker has marketed the drug without a valid prescription.
The suit alleges that the drug maker has marketed Levitra without the necessary FDA approval, "in the hope that men who may not have ED would not develop it and thus have an increased risk of a male-pattern disorder, a sexual disorder that is often associated with poor libido," according to the suit.
In addition, the drug maker has said that it has "discontinued" its sexual dysfunction medication. The suit claims that Levitra has been used by more than 2 million men in the U. over the past five years.
